1. About This Portal

PledgeCollect.com is an online payment portal operated by Fenety Marketing Services Atlantic Ltd. ("Fenety Marketing", "we", "us", or "our"), a telephone fundraising company based in New Brunswick, Canada.

This portal exists for one purpose: to give you a convenient, secure way to pay a pledge you already made over the telephone during a fundraising campaign conducted by Fenety Marketing on behalf of a charitable or nonprofit organization (the "Charity"). It is an alternative to mailing a cheque or providing payment by other means.

By using this portal, you ("you" or "Donor") agree to these Terms of Use. If you did not make a pledge by telephone and are not seeking to fulfill an existing pledge, please do not use this portal.

2. Your Pledge

A pledge is a commitment you made voluntarily during a telephone call with a Fenety Marketing fundraising representative. This portal does not create new pledges — it allows you to fulfill one you have already made.

By proceeding with payment, you confirm that:

  • You are the person who made the pledge during the telephone call
  • You are the authorized holder or user of the payment card or method you are providing
  • The amount you are paying matches or is consistent with the pledge you made
  • You are making this payment voluntarily to support the Charity named in your pledge

If you do not recall making a pledge, believe you have reached this portal in error, or have concerns about a call you received, please contact us before submitting any payment (see Section 8).

3. Who Receives Your Donation

Your payment is directed to the Charity identified during your telephone pledge. Fenety Marketing conducts fundraising campaigns on behalf of charitable and nonprofit organizations across Canada. We are a fundraising services company — we are not the Charity, and donations made through this portal are not made to Fenety Marketing.

The name of the Charity will be displayed on the payment confirmation screen before you submit your payment. Please verify it matches your intent before proceeding.

Tax receipts, if applicable, are issued by the Charity and are subject to their policies. Fenety Marketing does not issue charitable tax receipts.

4. Payment Processing

Payments are processed securely through Bambora (a Worldline company), a third-party payment processor. Your payment card information is entered directly into Bambora's secure system and is never stored on Fenety Marketing's servers.

By submitting payment, you authorize a one-time charge to your payment method in the amount you specify. You acknowledge that:

  • Payment processing is subject to Bambora's terms and conditions
  • Fenety Marketing does not store your full card number, CVV, or expiry date
  • Transaction confirmation will be displayed on screen upon successful processing
  • You should retain your confirmation for your records

4.1 Failed or Declined Transactions

If your payment is declined, no charge will be made. You may attempt payment again or contact us to arrange an alternative payment method. Fenety Marketing is not responsible for declines resulting from your card issuer's policies.

4.2 Refunds

If you believe a payment was processed in error or you wish to request a refund, please contact us promptly using the information in Section 8. Refund eligibility is determined in consultation with the Charity, as the funds are directed to them. Fenety Marketing will make reasonable efforts to facilitate a resolution.

5. Your Privacy

We collect only the personal information necessary to process your payment and record your pledge fulfillment. This includes your name, contact information, and payment transaction details. We do not sell your personal information.

Your information may be shared with the Charity on whose behalf your pledge was collected, and with Bambora for payment processing purposes. All handling of personal information is conducted in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

6. Security

PledgeCollect.com uses industry-standard encryption (TLS/HTTPS) for all data transmitted through this portal. Payment card data is tokenized by Bambora on the client side before transmission, meaning sensitive card details are never sent to or stored by Fenety Marketing's systems.

If you suspect fraudulent activity related to a payment made through this portal, contact your card issuer immediately and notify us as well.

7. Limitation of Liability

Fenety Marketing provides this portal as a convenience to donors. To the fullest extent permitted by law:

  • We are not responsible for the programs, activities, or use of funds by the Charity receiving your donation
  • We are not liable for payment processor errors, outages, or declined transactions
  • We are not responsible for internet connectivity issues or device-related problems that affect your ability to use the portal
  • Our total liability in connection with any claim arising from your use of this portal shall not exceed the amount of the transaction in question

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable Canadian law.

9. Governing Law

These Terms of Use are governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada. Any disputes arising in connection with your use of this portal will be subject to the exclusive jurisdiction of the courts of New Brunswick.

10. Changes to These Terms

We may update these Terms of Use from time to time. The current version will always be available on this portal. Your continued use of the portal after any update constitutes acceptance of the revised Terms.
